1. Acceptance of Terms

By using FNFISP’s & FNFSERVERS proxy/VPN services, and hosting you agree to abide by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

2. Service Description

FNFISP’s & FNFSERVERS provides proxy/VPN services, and hosting to enable users to access the internet securely and privately. The services may include

FNFISP is a digital solution that enables users to modify their IP address while navigating the internet, particularly on sneaker platforms. FNFISP furnishes users with a Virtual Private Network, or ALTERNATIVE PROXY, boasting rapid speeds for seamless web browsing and execution of desired activities throughout the Internet. This may encompass acquiring items from online stores or streaming videos on platforms like YouTube. The electronic offering will be sent to your Email AND/OR USER ACCOUNT dashboard. It will be presented in the form of a list, containing the corresponding quantity requested, the IP address, Web Port, Username and Password for authentication.

We cannot ensure the effectiveness of our solution in situations where a website has enabled Bot Protection.

3. User Responsibilities

Users are responsible for maintaining the confidentiality of their account credentials. They are also responsible for all activities conducted through their accounts. This includes not only

i. Remote Desktop Server/SSH credentials

ii. Proxy/VPN credentials

4. Prohibited Activities

Users may not engage in activities that violate local, state, national, or international laws while using FNFISP’s & FNFSERVERS services. Prohibited activities include but are not limited to

A) Prohibited Usage:

i. Engaging in any unlawful activities;

ii. Encouraging or soliciting others to participate in unlawful acts;

iii. Violating any international, federal, provincial, or state regulations, rules, laws, or local ordinances;

iv. Infringing upon or violating our intellectual property rights or the intellectual property rights of others;

v. Engaging in activities that harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on various factors, including but not limited to gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

vi. Providing false or misleading information;

vii. Uploading or transmitting viruses or any other type of malicious code that may impact the functionality or operation of the Service, related websites, or the Internet;

viii. Collecting or tracking personal information of others;

ix. Engaging in spam, phishing, pharming, pretexting, spidering, crawling, or scraping;

x. Using the service for obscene or immoral purposes;

xi. Interfering with or circumventing the security features of the Service or any related website, other websites, or the Internet.

xii. Infringing on any third party’s intellectual property or publicity/privacy rights;

xiii. Violating any applicable law or regulation;

xiv. Involving deceptive or fraudulent activities;

xv. Engaging in defamatory, violent, harmful, or obscene activities;

xvi. Introducing viruses, worms, Trojan horses, or other malicious computer programming routines with the intent to damage or interfere with systems, data, or personal information;

xvii. Attempting to harm FNFServers servers or other servers (e.g., through attacks, CPU-intensive programs, etc.);

xviii. Involving spamming, mail servers, mass marketing, or investment/lottery sites;

xix. Employing brute force, vulnerability-checking programs, or any form of attacks on security;

xx. Utilizing traffic exchange/relay websites, TOR nodes, open public proxies, topsites lists, or similar services;

xxi. Involving mass public file storage, high CPU/bandwidth usage, or disrupting the performance of other customers;

xxii. Crawling/scraping, loading an excessive number of websites, or running web macro plugins/scripts;

xxiii. Running programs/scripts designed for maximum CPU usage, such as cryptocurrency miners.

xxiv. Running a program/script that utilizes maximum CPU (e.g., cryptocurrency miners) beyond the processing power assigned to your service.

FNFServers reserves the right to determine the acceptability of Customer Content and may refuse any subject matter deemed inappropriate. Customer agrees to be liable for all costs associated with reversing damages caused by the violation of these provisions.

B) Security Measures:

i. Customer agrees not to circumvent, abuse, or attempt to circumvent or abuse FNFServers’ security measures and billing system;

ii. Prohibiting the creation of multiple billing accounts for the same Customer or from the same household;

iii. Limiting the use of multiple accounts to deposit funds exceeding the permitted amount;

iv. Prohibiting the creation of billing accounts for someone other than the Customer;

v. Avoiding the abuse of bugs in FNFServers’ system, with any such abuse leading to account closure and immediate Service termination without refund.

vi. FNFServers does not honor pricing mistakes on their website and reserves the right to cancel such orders.

C) Mass-mailing Restrictions:

i. FNFServers prohibits any form of mass mailing on its servers;

ii. Customers running scripts involving mass mailing are subject to suspension and/or termination at FNFServers’ discretion;

iii. If a Customer intends to run a legitimate mail server or send large volumes of e-mails in a non-spam manner, pre-approval from FNFServers is required.

D) High Usage Policy:

i. Usage that disrupts the overall performance of FNFServers’ server(s) is not permitted;

ii. Operating within specified usage parameters, which include limitations on high CPU, high load, high mail volume, high I/O, and high network usage.

iii. FNFServers reserves the right to deprioritize Customer’s Service(s) to prevent congestion and/or disruption of other customers’ performance.

iv. FNFServers is not responsible for failure to keep a backup and is not liable for data corruption or loss if a backup is available.

D) Interruption of Service:

i. Acknowledging that FNFServers is not liable for any actual or economic damages resulting from temporary delays, outages, or interruptions of Service(s);

ii. Recognizing that FNFServers is not responsible for damages, including loss of revenue, due to Service disruptions, data breaches, or data loss;

iii. Acknowledging that FNFServers cannot be held liable for any damages, to Customers or third parties, resulting from the use of FNFServers Services.

iv. Each party acknowledges that it has not entered into this Agreement in reliance upon any warranty or representation except those specifically set forth herein.

5. Privacy Policy

FNFISP & FNFSERVERS don’t sell any of your information. For the purpose of creating a transaction, the billing provider Stripe will need to collect information about you. They will log the IP address and web browser details used at purchase, and any information filled into the payment box such as, Contact information, Billing information. By using our services, you consent to the practices described in the Privacy Policy.

6. Subscription and Payments

Monthly subscriptions will have a 2 late period for every month the server has been rented. For example 3 months will grant 6 days before the service is disabled. Open ticket for payment options not mentioned

7. Intellectual Property

FNFISP & FNFSERVERS retains ownership of all intellectual property related to the services. Users may not reproduce, distribute, or create derivative works without explicit permission.

8. Termination of Service

FNFISP & FNFSERVERS reserves the right to terminate or suspend service to users who violate these Terms of Service without prior notice.

9. Limitation of Liability

FNFISP & FNFSERVERS is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services.

10. Modifications to Terms

FNFISP & FNFSERVERS reserves the right to modify these Terms of Service at any time. Users will be notified of changes, and continued use of the services after changes are made constitutes acceptance of the modified terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of United States of America.
